The nature of the violation(s) is (are) listed below: <br />The San Joaquin County Environmental Health Department (EHD) received information <br />regarding the above referenced location. Information provided by the underground <br />storage tank (UST) Operator, David Catanzarite, indicated that the UST piping associated <br />with the Boiler Room are not currently being operated and has not been in operation for <br />over one year. This information leads this office to believe that there may be abandoned <br />UST piping on the property. If so, this is a violation pursuant to: <br />California Health and Safety Code Section 25298(a): <br />No person shall abandon an underground tank UST system or close or temporarily <br />cease operating an underground tank UST system, except as provided in the section. <br />California Code of Regulations Section 2670(e): <br />During the period of time between cessation of hazardous substance storage and <br />actual completion of underground storage tank closure pursuant to section 2671 or <br />2672, the applicable containment and monitoring requirements of Articles 3 or 4 <br />shall continue to apply. The time period between cessation of hazardous substance <br />storage and application for temporary or permanent tank closure shall not exceed <br />90 calendar days. Closure shall be completed within a reasonable time period as <br />determined by the local agency. <br />r <br />
