November 7, 2006, were submitted to the EHD (Attachment 28). All violations noted in the 2007
<br /> inspection reports have been corrected.
<br /> On February 1, 2008, Mr. von FlUe performed a routine UST inspection and found that the annual
<br /> monitoring system certification, leak detector testing, and spill container testing were due by
<br /> November 2007 and had not been completed. Current financial responsibility documents had not
<br /> been submitted to the EHD, and documentation for employee training by the designated operator
<br /> was not found on site. Mr. von FlUe left a copy of the inspection report on site (Attachment 29).
<br /> On February 7, 2008, current financial responsibility documents were submitted to the EHD
<br /> (Attachment 30).
<br /> On March 3, 2008, Mr. von FlOe witnessed the annual monitoring system certification, leak
<br /> detector testing, and spill container testing, which were all four months past due. The 87- and 91-
<br /> octane
<br /> 1-octane spill containers failed a one-hour hydrostatic test. The owner provided a copy of the
<br /> employee training records (Attachment 31) and Mr. von FlOe left an inspection report on site
<br /> (Attachment 32). The monitoring system certification test report was submitted on April 9, 2008,
<br /> after 30 days (Attachment 33).
<br /> On March 5, 2008, a permit application, SR0053534, was submitted to replace the 87- and 91-
<br /> octane spill containers and was approved by Mr. von Fl0e on March 11, 2008 (Attachment 34).
<br /> On March 27, 2008, Ms. Michelle Henry, Senior REHS, EHD, witnessed the testing of the
<br /> replaced spill containers and verified the 5-gallon capacity. Both tests passed (Attachment 35).
<br /> On April 7, 2008, the November 16, 2006, monitoring system certification test report was
<br /> submitted (Attachment 20).
<br /> On October 13, 2008, Mr. Garrett Backus, Senior REHS, EHD, and Mr. Jeffrey Wong, Senior
<br /> REHS, EHD, were scheduled to witness the annual monitoring system certification, leak detector
<br /> testing, and spill container testing by Affordatest. When they arrived on site, Mr. Benjamin
<br /> Duncan of R&D Compliance Testing was performing secondary containment testing of the UST
<br /> system. Mr. Duncan called Affordatest and was told that they made a mistake with the
<br /> notification. Apparently the notification should have been for secondary containment testing.
<br /> Secondary containment testing was last performed on July 22, 2005, and was due by July 2008.
<br /> A secondary containment test report was submitted to the EHD(Attachment 36).

<br /> On September 30, 2004, Mr. Steven Shih, Senior REHS, EHD, performed a routine UST
<br /> inspection (Attachment 37) and witnessed the annual monitoring system certification and leak
<br /> detector testing. Spill container testing was last performed in May 2004 during the EV R upgrade
<br /> and was not due until May 2005. During the inspection, Mr. Shih found the 89-octane annular
<br /> sensor to be in alarm. Upon further investigation, approximately 24 inches of liquid was found
<br /> inside the annular space. According to the alarm history, which is included in the test report, the
<br /> original date of the alarm was August 2, 2004. The sensor could possibly have been in alarm for
<br /> 58 days. Current financial responsibility documents were not submitted to the EHD, monitoring
<br /> and response plans were not found on site, and maintenance and monitoring records were not
<br /> found on site. A monitoring system certification test report was submitted with a cover letter dated
