The <br />facility chose to use ball floats set at 90% to satisfy overfill prevention. Since ball floats have not <br />been installed in all open risers as required, the UST system fails to meet overfill prevention <br />requirement under Title 23 of the California Code Regulations (CCR). <br />Violation: The overfill prevention system is not currently functional on the UST system. <br />Corrective Action: Immediately discontinue deposition of petroleum into the USTs until EHD <br />inspector has verified the overfill prevention is in compliance with CCR 2635(b) (2): <br />(2) The overfill prevention system shall ... meet one of the following requirements: <br />(A) Alert the transfer operator when the tank is 90 percent full by restricting the flow into <br />the tank or triggering an audible and visual alarm; or <br />(B) Restrict delivery of flow to the tank at least 30 minutes before the tank overfills..., and <br />activate an audible alarm at least five minutes before the tank overfills; or <br />(C) Provide positive shut-off of flow to the tank when the tank is filled to no more than 95 <br />percent of capacity, or, <br />(D) Provide positive shut-off of flow to the tank so that none of the fittings located on the <br />top of the tank are exposed to product due to overfilling. <br />Please be aware that any repair or modification of the UST system must be performed by a <br />properly licensed, trained, and certified contractor under permit by EHD. <br />Please be advised that failure to correct the violation will cause continuing/additional violations <br />and may result in further legal action. <br />If you have any questions, please contact Jeffrey Wong, Senior REHS, at (209) 468-0335. <br />Jeffrey Wong, Senior REHS <br />Underground Storage Tank Program <br />cc: BAP Enterprises, Inc., 437 N.
