In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). The secondary containment testing results from December 1/29/2015 testing indicate a failure at the following under dispenser containments: UDC 3/4, UDC 7/8 and UDC 11/12. To date no repairs t the secondary containment or re-testing of the secondary containment was conducted. Th underground storage tank system must be operated to prevent unauthorized releases, and al secondary containment for the UST system must be tight (HSC 25290.1, HSC 25290.2, 23 CC 2662, and 25291). A 7-day "Red Tag" warning letter was delivered to the facility on April 28, 2017. The 87-octane and the 91-octane systems were Red Tagged today. To avoid your system remaining Red Tagged, immediately submit a permit application to the EHD to repair and subsequently retes the failed secondary containment components, complete all necessary repairs and conduct the required secondary containment testing with passing results. Please be aware that you are in violation and that each day of non-compliance is a separate violation.
