7&Z <br />NDB G LEASE (the "Lease") is made and entered into as of the L day <br />,20(the "Effective Date"), between Dean H. Sandquist and Diane A. <br />Sandqrustees, Sandquist 1996 Trust, having an office at 78 Sea Way, San Rafael, <br />California 94901, ("Landlord") and Rajendra a' N. Sethi having a <br />principal address of _11 Steele Court, Bay Point, Ca. 94565 ("Tenant"). <br />RECITALS <br />A. Landlord is the owner of certain real property located at 3304 West Hammer Lane, <br />Stockton, California (the "Real Property"). Said Real Property is more particularly described in <br />Exhibit A attached hereto. <br />B. Tenant desires to lease from Landlord the Real Property, to operate thereon a <br />gasoline service station and convenience store. The buildings and all improvements to or on the <br />Real Property, including but not limited to all site work, landscaping, fuel tanks, fuel dispensers, <br />utilities, and other improvements, are collectively referred to herein as the "Building". <br />C. The Real Property and the Building collectively shall <br />be referred to as the "Demised Premises." <br />D. Tenant desires to lease the Demised Premises from Landlord on the terms <br />and conditions hereinafter set forth. <br />NOW, THEREFORE, in consideration of the lease of the Demised Premises and the rents, <br />covenants and conditions herein set forth, Landlord and Tenant do hereby covenant, promise and <br />agree as follows: <br />KAW41il l <br />DEMISE OF PREMISES <br />Landlord does hereby lease unto Tenant, and Tenant does hereby hire from Landlord, for the <br />term hereinafter provided in Section 2.01, the Demised Premises for the use thereof by Tenant, <br />Tenant's employees, concessionaires, licensees, agents, customers and invitees, which use shall <br />be exclusive except as otherwise provided in Section 3.06 or elsewhere herein. <br />ARTICLE II <br />TERM <br />Section 2.01 <br />(a) The "Commencement Date" of this Lease shall be / The <br />Lease shall continue for a period of Five (5 ) years from the <br />Commencement Date (the "Original Lease Term").
