CJ <br />and terminate any existing subleases and not enter into any new subleases <br />under the Lease. <br />Section 26.09 Immediately upon the recording of the Leasehold Mortgage, Tenant, at Tenant's <br />expense, shall cause to be recorded in the office of the County Recorder of the county in which <br />the Demised Premises is located, a written request duly executed and acknowledged by Landlord <br />for a copy of any notice of default and of any notice of sale under the Leasehold Mortgage, as <br />provided by California Civil Code' 2924b. <br />Section 26. 10 If title to Landlord's estate and to Tenant's estate are acquired, by the same person <br />or entity, other than as a result of termination of this Lease, no merger shall occur if the effect of <br />such merger would impair the lien of any Leasehold Mortgage. <br />Osw0c.1 <br />IsIgnwII11 : ► • • Y 11 <br />Section 27.01 The term "Outside Areas" shall refer to all areas outside of the buildings including <br />all sidewalks, driveways, landscaping, trash enclosures, and trash compacting and loading areas <br />on the Demised Premises. <br />Section 27.02 Tenant shall be responsible for maintaining the Outside Areas in a neat and clean <br />condition, and shall ensure that debris are cleaned on a regular basis. <br />CERTIFICATES <br />Section 28.01 <br />(a) Tenant shall, without charge, at any time and from time to time, within ten (10) <br />days after request by Landlord, deliver a written instrument to Landlord or any other person, <br />firm or corporation specified by Landlord, duly executed and acknowledged, certifying such <br />information as is reasonably requested by Landlord, which may include confirmation that: <br />(i) This Lease is unmodified and in full force and effect, or if <br />there has been any modification, that the Lease is in full <br />force and effect as modified and stating any such modification; <br />(ii) Whether or not there are then existing, to the knowledge of <br />the executing officer, any defenses against the enforcement <br />of any of the agreements, ten-ris, covenants or conditions of <br />this Lease upon the part of Tenant to be performed or <br />complied with, and, if so, specifying same (including, <br />without limitation, whether Tenant knows or does not know <br />of any default by Landlord in Landlord's performance of all <br />agreements, terms, covenants and conditions to be <br />performed by Landlord, and if such default does exist, <br />specifying same); and <br />30 <br />
