Taddei Road, Acampo, CA, is not <br /> eligible for reimbursement from the Underground Storage Tank Cleanup Fund <br /> (Fund) . It is being proposed, therefore, that your claim be removed from the <br /> Priority List based on the following reason(s) : <br /> On August 26, 1993, staff from the Cleanup Fund conducted an in-depth review <br /> at the San Joaquin County Environmental Health Department. (county) . It was <br /> determined that you were out of compliance with corrective action directives <br /> issued by the County. Corrective Action on site has been performed and paid <br /> for by the new owners. <br /> Section 2810.1 (a) (2) of the Petroleum Underground Storage Tank Cleanup Fund <br /> Regulations provides that eligible claimants are any owner or operator of an <br /> underground storage tank for which a permit is or was required under Section <br /> 25284 of the California Health and Safety Code who undertook or undertakes <br /> corrective action after January 1, 1988, pursuant to a local agency order, <br /> directive, or notification of cleanup responsibility, . . . . and (6) A person <br /> who has paid or will pay for the costs claimed. <br /> Since you never complied with corrective action directives issued to you by <br /> the county and never paid for the cleanup costs for this site, you are not <br /> eligible for reimbursement from the Fund. Therefore, your claim is being <br /> removed from the Priority List. <br /> If you do not agree with this decision, you may request a Final Staff Decision <br /> within thirty (30) calendar days of receipt of this Notice.
