Taddei Road, Acam o -- Your Site No. 1733 <br /> Dear Mr. Knoll: <br /> As you may recall, I spoke with you when our office was <br /> initially retained by Mr, and Mrs. Lorz. <br /> We received a copy of your certified letter dated Octo- <br /> ber 3, 1990 to Mr, and Mrs. Harry Lorz on October 16, 1990 <br /> (Mrs. Lorz picked it up from the post office on October 15, <br /> 1990) . Any correspondence to the Lorzs should be directed <br /> ,to our o ffice as their legal- repr.es-ehtative-.' As the Lorzs <br /> are not the property owners, and not the Potential Responsi- <br /> ble Party, the Lorzs will not meet your fourteen day dead- <br /> line. After reviewing all of the information provided by the <br /> Lorzs, I must request that the Potential Responsible Party <br /> (PRP) be changed to Mr. and Mrs. Ronald Conway, the current <br /> owners of the property at 381 W. Taddei. Road, Acampo. As the <br /> current owners, the Conways are clearly the legal PRPs. <br /> Although, the Lorzs may be the prior owners, they have not <br /> undertaken any obligation for the property. At this point, <br /> the Lorzs are investigating all their options because of <br /> their substantial financial constraints . <br /> Also, the Soil Remediation Workplan and Soil Remediation <br /> Proposal submitted by Falcon Energy Associates, Inc, was in <br /> error in the last few sentences of 1 . 0 Site History. The <br /> Site History concludes that there is no issues as to who is <br /> responsible for the tanks. Falcon Energy Associates were not <br /> the Lorzs ' legal representative and were not authorized to <br /> make any statement as to how the legal obligations as between <br /> the parties were to be divided. <br /> Based on the foregoing, it is our position that the <br /> Lorzs ' responsibility for the underground storage tank prob- <br /> LTR.B1/TXTBKB/2 <br />
