RETURN RECEIPT REQUESTED <br /> 329 Prado Way <br /> Stockton, CA 95207 <br /> SOUTHLAND 9110 THORNTON ROAD, STOCKTON, RENEWAL OF SITE ACCESS FOR CONTINUED <br /> INVESTIGATION AND REMEDIATION OF SOIL AND GROUND WATER CONTAMINATION, <br /> IMPENDING ENFORCEMENT ACTION <br /> The California Regional Water Quality Control Board, Central Valley Region has <br /> been working with you and Southland Corporation (Southland) during the <br /> investigation and remediation of ground water contamination at the subject <br /> site. Southland has attempted to comply with our requests and the requests of <br /> the San Joaquin County Department of Public Health Services to continue <br /> investigation and remediation of soil and ground water contamination. <br /> However, to continue the necessary investigation and remediation, your <br /> cooperation in renewing the access agreement for the site is necessary. Your <br /> representative has indicated that access to the site would be granted after a <br /> number of financial provisions are agreed to. These financial provisions <br /> include compensation for the decrease in value of the property due to the <br /> contamination, and other provisions not directly related to site access for <br /> the investigation. <br /> To protect water quality, your cooperation in granting Southland access to <br /> this site will be necessary. Please be aware that ground water contamination <br /> is a very serious matter. The Regional Board requires dischargers to cleanup <br /> and abate the effects of discharges to waters of the state. Pursuant to <br /> California Water Code, you, as the property owner, may be viewed as a <br /> discharger. Regional Board staff has contacted you and your representatives <br /> requesting your cooperation in granting Southland reasonable access to the <br /> site for conducting the necessary investigation. You were informed that the <br /> issue of granting site access should not be conditioned on other agreements <br /> not directly related to access for the purpose of investigation. You were <br /> also informed that if you withheld site access you would be obstructing the <br /> investigation and, therefore, could be included in a formal enforcement order <br /> currently being considered. <br />
