Finally, pursuant to Paragraph 5 of the October <br /> 22 Agreement, this firm requests the reimbursement of all <br /> attorneys ' fees and costs incurred by Tang Fat and Mr. Dominic <br /> Chu on behalf of Tang Fat as a result of this matter. <br /> As you may or may not be aware, both the Pharmacy and <br /> Arcade operations, as neighborhood-oriented businesses, have <br /> experienced steady loss of business, and commensurate loss in <br /> value. The neighbors ars fully aware of the contamination <br /> problem, and have been so for some time. As such, Mr. Chu has <br /> received many comments from the public that they are not <br /> anxious to frequent any business related to the health <br /> industry, and which allow their children to be exposed for <br /> extended periods of time to contaminants. Y also mentioned <br /> that Mr. Chu has personally suffered certain health effects <br /> from daily exposure at the location. As you approved, we will <br /> request that the County Air Pollution Control District monitor <br /> any vapor released. Notwithstanding this procedure, Mr. Chu <br /> has requested that a business appraiser be selected and <br /> appointed who is mutually agreeable to both parties to <br /> establish the diminution in value caused to the Pharmacy and <br /> Arcade as a result of the contamination problem. The <br /> differential between the true fair market value and the <br /> diminished value as a result of the contamination would be paid <br /> to Mr. and Mrs. Chu and MegaVonn, Inc. in settlement of any <br /> property or business damages claimed. <br /> If I may be of any assistance in explaining any of <br /> the above items, please do not hesitate to contact me.
