STOCKTON, CALIFORNIA 95201 <br /> Telephone: 209-468-3470 <br />' Before the Hearing Board of the San Joaquin County Air pollution <br /> Control District <br />' <br /> In the matter of the Replication of Vapor Extraction Technology, Inc. , <br /> 2261 Market St. , Suite 312 , San Francisco, California, for a Variance <br /> and Schedule of Compliance . <br />' ORDER NO . 89-73 <br /> The application of Vapor Extraction Technology in the above entitled <br />' matter came on regularly for a hearing on January 11 , 1990 after public <br /> notice of the application and hearing first having been given for at <br /> least 10 days before the hearing Notice was given the California Air <br /> Resources Board and the Regional Administrator, Region IX, <br />' all in conformance frith the <br /> Environmental Protection Agency, <br /> requirements of Section 40825 of the California Health and Safety Code , <br /> the matter having been called and the applicant, Vapor Extraction <br />' Technology with their representative , Tom Lahey appearing <br /> and all <br /> persons interested in the application having been heard and the matter <br /> having been taken under submission for decision <br /> Therefore , the Board finds <br /> Notice of the application and the '-carina- , thereon, has been duly <br /> and regularly given as required by State later and regulation Good <br /> cause exists for the granting of a fariancf, as is hereinafter more <br /> particularly set forth <br /> Vapor Extraction Technology- <br />' <br /> 1 Is in violation of Rule 201 of the San Joaquin County Air <br /> pollution Control District <br />' 2 . Cannot comply with the above Rules and Regulations because of <br /> conditions beyond its control <br /> 3 Forced immediate compliance would result in the closing of <br /> Vapor Extraction Technology and the elimination of a ) aitfu] <br /> business without corresponding benefit in reducing air <br />' contaminants. <br /> 4 Vapor Extraction Technoloqy has given consideration t( <br />' curtailing operations of the source in lieu of obtaining <br /> variance , <br /> 5 During the period the variance is in etfect , Vapor Extractl", <br /> Technology will cause no excess emissions , and <br /> 6 During the period the variance is in effect, Vapor Extractio <br />' Technology will monitor or otherwise quantify emission level <br /> from the source , if requested to do so by the district, �.n <br /> report these emission levels to the district pursuant to <br />' schedule established by the dis=riot <br />
