The following is an itemized list of hazardous waste violations that have not been <br /> addressed for FALLING PRICES INC as of May 20, 2020. <br /> Open violations from November 21, 2019 inspection <br /> Violation#102-Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: <br /> 1.A plywood shelf was observed containing a bottle of choline chloride Hi-LR, Bat Magic-bat repellent scent <br /> packs, Ultra Shield EX Fly Spray, Tide Odor Rescue In-Wash Laundry Booster pods, Daisy' Goat Milk Laundry <br /> Soap, Glostick Flying Insect Trap, boxes of Miracle Gro All Purpose Plant Food, boxes of Pic Fly Ribbon insect <br /> traps,Wondershop Globe Lights(see photos IMG 9623-44).A plywood box was observed filled with boxes of <br /> Festive Battery Operated LED Timer Lights(IMG 9645-6).Another plywood box was observed filled with health & <br /> beauty products, including but not limited to, bottles of lotion, liquid shampoo, hair conditioner, body wash, and <br /> mouthwash, boxes of Garnier Nutrisse and Clairol permanent hair coloring kits, and toothpaste(IMG 9651-66). <br /> According to Sarah Rowland,Assistant Store Manager, all of the facility's weekly liquid laundry detergent had <br /> already been sold to customers. <br /> When asked how the facility manages items, including liquid chemicals, such as laundry detergent and other <br /> cleaners,that are found broken or leaking in the facility or in a product shipment to the facility, Sarah Rowland, <br /> Assistant Store Manager, stated that the facility throws any broken or leaking items into the trash. <br /> When asked how the facility cleans up a spill of a liquid chemical, Sarah stated the facility employees will use paper <br /> towels to clean up a spill and throw the paper towels into the trash. <br /> When asked what the facility does with items, including liquid chemicals,that are not bought by customers by the <br /> time the store closes on Saturday, Sarah stated that items will be left on the sales floor for another week to be sold <br /> to customers.According to Sarah, if the items still do not sell by the end of the second week,the facility will throw <br /> the items into the trash. <br /> The facility has not implemented a hazardous waste management program. <br /> 2.At the time of inspection,the signage on the Falling Prices store front read BidRL.com (IMG 9667-9).According <br /> to Philip Parra, District Manager, BidRL.com, an online auction market place owned by the owners of Falling <br /> Prices, is no longer operating at this location due to the opening of Falling Prices. <br /> Two 1 gallon containers of Diversey Oxivir Tb(General Virucide, Bacericide, Tuberculocide, Fungicide, Sanitizer) <br /> and two 1 quart containers of Sustainable Earth by Staples Carpet Spotter were observed on plywood shelving in <br /> the facility's back storage/receiving area(IMG 9613-9).According to Sarah Rowland, and Philip Parra, District <br /> Manager,the items on these shelves were paid for, but were never picked up or were abandoned, by customers on <br /> BidRL.com.According to Philip, it is unknown at this time if BidRL.com will reopen at this location. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately implement a hazardous waste management program and stop disposing of <br /> chemical and potentially hazardous waste into the trash, make a hazardous waste determination for each waste, <br /> including the chemical containers observed in the facility's receiving area if they are determined to be waste, and <br /> manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other <br /> knowledge to support your hazardous waste determination. Waste testing must be done using methods specified <br /> in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation explaining your hazardous waste management program, and <br /> your hazardous waste determinations. Submit a statement explaining how the chemical containers observed in the <br /> facility's receiving area will be managed. Demonstrate current storage and labeling for wastes determined to be <br /> Page 2 of 4 <br />
