The following is an itemized list of hazardous waste violations that have not been <br /> addressed for Victory Auto Sales as of June 04, 2020. <br /> Open violations from February 21, 2020 inspection <br /> Violation#101 -Managed a hazardous waste without an identification number. <br /> OBSERVATION:This business does not have a hazardous waste ID number in the California Department of Toxic <br /> Substances Control(DTSC)database. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of,transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA)Identification <br /> (ID)Number. A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at <br /> hftps://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/to obtain a State ID number. Immediately apply for <br /> your ID number and submit evidence to the San Joaquin County Environmental Health Department within 30 days. <br /> ❑ This violation was corrected ❑This violation will be corrected by(date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation#102-Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: <br /> 1.An unlabeled bag of oily rags was observed on top of the facility's used oil tank. <br /> 2.A 5 gallon container of Premium Fibered Aluminum Roof Coating was observed on top of the facility's used oil <br /> tank. <br /> 3.An open container labeled ChemStation Heavy Duty Degreaser containing either degreaser or used oil was <br /> observed on the ground next to the facility's used oil tank. <br /> 4.A blue container labeled Henry containing what appeared to be grease or sealant was observed on top of the <br /> facility's used oil tank. <br /> According to Yobani Torres, manager and the business owner's son,the above mentioned items are waste. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately make a hazardous waste determination for the waste mentioned above, and <br /> manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other <br /> knowledge to support your hazardous waste determination. Waste testing must be done using methods specified <br /> in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes <br /> determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br /> hazardous waste generator status. <br /> Page 1 of 6 <br />
