I am pleased to note your <br /> affirmation that Unocal will continue to remain a responsible corporate citizen...a position <br /> I do find somewhat at odds with your statement that you regard "our business relationship <br /> as being properly ended"! <br /> With so many contractural matters unresolved, I am compelled to remind you that our <br /> business cannot be concluded until-all matters are mutually agreed upon by both parties. <br /> The current lease provisions were established by mutual signature and accordingly are to <br /> be concluded by mutual signature. I add that the same applies to your two appendices: <br /> viz, Lease Cancellation and License Agreement, which, incidentally in their current forms <br /> are unacceptable to us. <br /> I do note, however, that you are persisting in circumventing your ongoingoin lease <br /> obligations by arbitrarily attempting to shift the site remediation into a "monitoring" phase. <br /> This ploy will not work, Mr. Senner, as the contracturally mandated mitigation'process is <br /> far from complete.....a fact evidenced by your inability to produce all of the required sign- <br /> offs. Again, this lease will only be cancelled when all conditions have been met...not when <br /> one party decides they no longer want to abide by mutually agreed-upon lease provisions <br /> and contractural obligations! <br /> At the risk of seeming repetitive, I wish to draw your attention once more to para.23, <br /> pg.12 of the lease modification, which I, too, will reproduce in its entirety for your benefit. <br />
