Mr Harlin Knoll, (SJCPHS), has upon my request, reviewed his documentation in <br /> this regard and has advised that his department is planning to set up a meeting between <br /> CSWRCB, SJCPHS. your geologist of record and Unocal representative, Mr Ed Ralston, <br /> to discuss the issue of further investigative testing of the area omitted in your study. As of <br /> my conversation with Mr Knoll last week, Mr Ralston has been "unavailable" to arrange a <br /> date for this meeting! <br /> By now, I think you are fully aware of our position: namely that Unocal has a clear <br /> contractural obligation to perform and ensure that this entire property be properly and <br /> thoroughly investigated and remediated to CSWRCB standards and completely signed off <br /> by "all federal, state and local governmental agencies" (2nd Mod. of Lease, pg.13, Apr.l <br /> 1992). Only then can mitigation be considered complete. I am not going to be brushed off <br /> in this matter by a new spirit of non-cooperation, which I have never encountered in all <br /> my past dealings with Unocal! Furthermore, during this ongoing mitigation period, I <br /> expect full payment of rent and taxes as outlined in the lease, until all provisions of said <br /> lease have been satisfied. <br /> Timeliness and Marketability <br /> While I realize that mitigation is a somewhat lengthy process, it is of paramount concern <br /> to me that this site clean-up does not degenerate into an untimely, prolonged affair. <br /> Considering Unocal's ongoing financial obligations until this site is completely mitigated, <br /> I cannot understand your lack of insistence that your various geology sub-contractors <br /> properly document and investigate the property as a whole. This omission on your behalf <br /> is costing both of us time and money and, as far as I am concerned, any further delay will <br /> adversely affect our marketing and development efforts. As to well MW3A, due to the <br /> mistaken property line, it is now clearly in the middle of where a development pad would <br /> be placed. As a "reliable data" point that cannot be disturbed, it does impede our <br /> sale/development plans. Just another reason, we do not consider your obligations finished. <br /> As of this date, you are in arrears on your monthly lese payments ( due: October 1994, <br /> November 1994 and soon December 1994 forward, plus taxes from July 1994 forward. <br /> Also, I have still not received the necessary sign-offs from the City of Tracy, nor a <br /> location map of utilities stub-outs, as requested. <br /> I would appreciate your continued co-operation and expedient action in resolving these <br /> matters in the hope that our remaining business transactions will continue to remain <br /> cordial. <br /> Sincerely, <br /> Kathleen Gayner Deutsch <br /> For the Gayner Family Partnership <br />
