Box 5155 <br /> San Ramon, CA. 94583 <br /> Re: Site Remediation, Unocal SS#6348 Tracy, CA. <br /> Dear Mr. Ralston, <br /> I am enclosing copies of self-explanatory correspondence I have forwarded to Mr. Ron <br /> Senner of your office, regarding the status of the station site clean-up Unocal is currently <br /> undertaking on property owned by the Gayner Family Partnership. <br /> As you will note from the content of the enclosed letters, you will see that I have raised <br /> concerns with your Company and the sub-regulatory agency,the SJCPHS, regarding what <br /> I consider as being an incomplete scope of remediation and investigation of the above site. <br /> As of last week, Mr. Harlin Knoll, SJCPHS (209)468-3442, had informed me that he was <br /> unable to contact you regarding setting up a meeting with him, Unocal's geologists of <br /> record and the CSWRCB, at which time the subject of further remediation will be <br /> addressed. I would appreciate your contacting Mr. Knoll as soon as possible to make the <br /> necessary arrangements, in order to resolve this problem without and more costly delays <br /> to both of us. <br /> As I have outlined to Mr. Senner,the additional matters of your non-compliance with the <br /> lease provisions, (with regard to ongoing lease payments, amongst other things ,) have yet <br /> to be satisfactorily resolved. I can assure you, Mr. Ralston, that inspite of your in-house <br /> "CERT Sales Release Letter", this property, in its present imcomplete state of <br /> remediation, is far from being ready for release for development! The status of <br /> "Remediated partially" as outlined in the aforementioned letter, is riol a valid provision of <br /> the current lease modification. Your financial obligations under the lease clearly are <br /> ongoing until such time as you can deliver a completely remediated and 51ned-o_ff site.---- <br /> A condition.you have so far failed to meet! <br />
