Senner, <br /> I wish to acknowledge receipt of your letter of October 7 , 1994 <br /> and to thank. you for your offer to leave the site barrier in <br /> place until August. 1995 . I am currently having 'my lawyer review <br /> the lease cancellation and License Agreement documents, which <br /> were enclosed in your,. letters of October 5 , 1994 . <br /> I do have, however, some .points regarding the site remediation <br /> that I feel need :- further discussion, ,now that I am in possession <br /> of the complete Remediation Report. <br /> It is my impression that your geologist, Mittlehauser Corp. <br /> has presented you with an incomplete report. It appears that <br /> the scope of the site analysis has been limited to the actual <br /> gas station pad, and has ignored treating the strip of land <br /> at the rear of the subject property. This apparent oversight <br /> was brought to your predessor ' s Attention .( see attached letter . <br /> to Mr. Bob Fest of 3/18/93.)-. at, which' time a ,photo montage <br /> was used to illustrate that .your contractor was only remediating <br /> the actual station site,;by staying within the arbitrary confines <br /> of the temporary barrier fence. <br /> This vacant strip is part of the site Unocal had under lease; <br /> and, accordingly must be the subject of Remediation Analysis, <br /> before we are prepared to sign the Lease Cancellation Agree- <br /> ment . Our : future marketing, development plans and borrawiing <br /> ability for the site are completely dependent upon a "clean" . <br /> site for the entire parcel. . . Not just the old station site. <br />
