Senner, I wish to acknowledge receipt of your letter of October 7 , 1994 and to thank. you for your offer to leave the site barrier in place until August. 1995 . I am currently having 'my lawyer review the lease cancellation and License Agreement documents, which were enclosed in your,. letters of October 5 , 1994 . I do have, however, some .points regarding the site remediation that I feel need :- further discussion, ,now that I am in possession of the complete Remediation Report. It is my impression that your geologist, Mittlehauser Corp. has presented you with an incomplete report. It appears that the scope of the site analysis has been limited to the actual gas station pad, and has ignored treating the strip of land at the rear of the subject property. This apparent oversight was brought to your predessor ' s Attention .( see attached letter . to Mr. Bob Fest of 3/18/93.)-. at, which' time a ,photo montage was used to illustrate that .your contractor was only remediating the actual station site,;by staying within the arbitrary confines of the temporary barrier fence. This vacant strip is part of the site Unocal had under lease; and, accordingly must be the subject of Remediation Analysis, before we are prepared to sign the Lease Cancellation Agree- ment . Our : future marketing, development plans and borrawiing ability for the site are completely dependent upon a "clean" . site for the entire parcel. . . Not just the old station site.
