S0 JOA U 1 Environmental Health Department <br /> U ; i y <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> Fremont Plaza Ace Hardware 2060 E Fremont St, Stockton June 05, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 106 CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. <br /> OBSERVATION: At the time of inspection, it could not be demonstrated (not necessarily documented)that <br /> employees who handle hazardous waste were properly trained.The facility does not have an employee hazardous <br /> waste training program in place. <br /> REGULATION GUIDANCE: The business owner must ensure that all employees are thoroughly familiar with <br /> proper waste handling and emergency procedures, relevant to their responsibilities during normal facility operations <br /> and emergencies. <br /> CORRECTIVE ACTION: Immediately train the employees. Provide proof of training and the training materials <br /> within 30 days to the San Joaquin County Environmental Health Department(EHD)for employees whose <br /> responsibilities include hazardous waste. <br /> This is a Class II violation. <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection. <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in <br /> accordance with section 66262.23(a)for three years or until the generator receives a signed copy from the <br /> designated facility which received the waste.This signed copy shall be retained as a record for at least three years <br /> from the date the waste was accepted by the initial transporter. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the past three years,from 6/5/2017 through <br /> 6/5/2020,for all hazardous waste including used cutting oil. Provide these records and a corrective action <br /> statement to the EHD within 30 days. <br /> This is a Class II violation. <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: Copies of consolidated manifest receipts from 6/5/2017 through 6/5/2020 for hazardous wastes, <br /> including used cutting oil,were not found on site during the inspection <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action <br /> regarding the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts from 6/5/2017 through <br /> 6/5/2020 and maintain them on site.
