4
Ms. Witul,

Good morning. I am legal counsel for King Island Enterprises, Inc. (dba King Island Marina) in Stockton.

I am emailing you regarding the SPCC plan and to answer your questions concerning the relationship between
business entities.

P.S. Marinas 5 (dba Westrec), a cancelled partnership, is the former owner of the property that is the subject of the
SPCC plan.

King Island Enterprises, Inc. purchased a portion of the subject property, and is in escrow to purchase the remaining
portion (which, when the transaction is completed, will comprise the same exact property as previously held by P.S.
Marinas 5). I hope this sufficiently clarifies the relationship between entities.

As to the SPCC plan, I have reviewed the checklist of deficiencies. Frankly, as I am not an engineer or geologist, I do not
know the technical aspects regarding correcting any such deficiencies.

In order to correct, what would you suggest? For example, may we retain an engineering firm to study and correct
those deficiencies or otherwise address the checklist, so that we may avoid the high cost of procuring a new SPCC
plan?

Please advise on your recommendations to ensure my client is compliant with EPA requirements.

Thank you Ms. Witul.

Jimy Hu, Counsel for King Island Enterprises, Inc.
