1 . "Fence" means a wall or barrier connected by boards , <br /> masonry, wire, or any other material for the purpose of <br /> enclosing space or separating parcels of land. The term <br /> "fence" does not include retaining walls, but does <br /> include fence gates and gateposts. <br /> 2 . "Fence height" means that the height of any fence shall <br /> be determined by measurement from the natural or finished <br /> grade at the lowest side of the fence. If a fence is <br /> proposed to be built on top of an earthen berm or other <br /> landscape feature, the maximum fence height shall include <br /> the height of the berm or landscape feature. <br /> 3 . "Open fence" means the same as "fence" except that <br /> materials used in the construction of the fence shall <br /> afford a clear view between the road or adjoining proper- <br /> ties and the property that is fenced. Materials used to <br /> build an open fence may include wire, wood rails, chain <br /> link, and wrought iron. <br /> B. Special Fence Provisions: <br /> 1. Noise Attenuation Walls. Walls, fences, berms, and/or <br /> landscaping for the purpose of noise attenuation may be <br /> required in any zone when adjacent to a high noise <br /> generator such as a major roadway or railroad. Noise <br /> attenuation requirements will be developed in response to <br /> the noise level and source affecting specific property. <br /> Height and yard restrictions for walls may be waived as <br /> required for effective noise reduction. <br /> 2 . Tennis Courts. The seven (7 ) foot fence height limit may <br /> be waived for tennis courts , as long as the tennis court <br /> is located in a side or rear yard and open type fencing <br /> material is used. <br /> 3 . Levees. The height of any fence located at the toe of a <br /> levee may be increased to eight feet subject to the <br /> review and approval of the Director. <br /> 4 . Fences Adjacent to "Restricted" or "Non-Access" Property. <br /> A fence up to seven ( 7 ) feet in height may be constructed <br /> at the property line when that line is shown as <br /> restricted or "non-access" on a recorded map, subject to <br /> the review and approval of the Director. <br /> 5 . Exceptions for Landscaping. Landscaping can be used to <br /> provide visual screening and fencing in any yard in an <br /> agricultural or residential zone as long as safe sight <br /> distance is provided.
