SECTION 7. Table 9-310.3, Chapter 9-310, Division 3, Title 9, of the San Joaquin County <br /> Ordinance Code Is hereby repealed. <br /> SECTION 8. Section 9-315.7, Chapter 9-315, Division 3, Title 9, of the San Joaquin County <br /> Ordinance Code Is hereby amended by amending subsection (b) to read as follows: <br /> Section 9-315.7 Guarantees for Continued Affordability. <br /> (b) The developer shall enter into an Agreement with San Joaquin County to ensure <br /> compliance with the provisions of this section. <br /> SECTION 9. Section 9-405.5 is hereby added to Chapter 9-405, Division 4, Title 9, of the San <br /> Joaquin County Ordinance Code to read as follows: <br /> Section 9-405.5 Special Use Regulations in Commercial Zones. In addition to the provisions <br /> of Sections 9-405.2 through 9-405.4, the following regulations shall apply to Commercial <br /> Zones: <br /> (a) Unless the use type is more restrictive, a Site Approval (Section 9-818) Is required <br /> for any commercial use that Is: <br /> (1) Six thousand (6000) feet or greater in ground floor area; <br /> (2) Occupies ten (10) or more acres of site area; or <br /> (3) Not served by a public wastewater treatment plant, public water system, and <br /> a public drainage system; <br /> (b) Outside displays or storage shall require a Site Approval, unless the review method <br /> for the use type is more restrictive. <br /> (c) Any change in an existing commercial use to a new commercial use which requires <br /> either a Site Approval or an Improvement Plan shall be permitted without a Site <br /> Approval or Improvement Plan, provided the Review Authority finds that the proposed <br /> use is less detrimental to, or will have no greater impact in,the zone than the existing <br /> use. <br /> SECTION 10. Table 9-405.2, Chapter 9-405, Division 4, Title 9, of the San Joaquin County <br /> Ordinance Code is hereby amended by amending the Table Note to read as follows: <br /> Table 9-405.2: Uses In Commercial Zones <br /> Note: See Section 9-405.5 for Special Use Regulations in a Commercial Zone. <br /> SECTION 11. Table 9-405.2, Chapter 9-405, Division 4, Title 9, of the San Joaquin County <br /> Ordinance Code Is hereby amended by amending the permit type for the C-X Zone for Retail Sales <br /> & Services, Primary use type to read as follows: <br /> Table 9-405.2: Uses In Commercial Zones <br /> Retail Sales & Services, Primary <br /> —4— <br />
