TA-88-7 (ALL DISTRICTS ) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors: <br /> 1. Approve the Negative Declaration and instruct the <br /> Clerk to file a Notice of Determination; and <br /> 2. Approve Planning Title Text Amendment No. TA-88-7, based <br /> on the "Bases for Recommendation" given in the staff <br /> report. <br /> REASON FOR RECOMMENDATION: <br /> The proposed Text Amendment would enable the County to enter <br /> into a Development Agreement with a landowner or any other <br /> person having an equitable interest in land that is proposed <br /> for development. When processed concurrently with a General <br /> Plan Amendment or a Zone Reclassification, a Development <br /> Agreement could be used to restrict future uses of property. <br /> Currently, without a Development Agreement, no such restric- <br /> tions on the future uses of property can be imposed at the <br /> time of General Plan Amendments or Zone Reclassifications. <br /> Under a Development Agreement, the developer agrees to commit <br /> his property to specific uses, construct specific improve- <br /> ments, provide certain facilities and services, develop <br /> according to a specific time schedule, or make other <br /> commitments that the County might not otherwise be able to <br /> compel a developer to perform. In return, the County agrees <br /> i to base future land use decisions for the subject property on <br /> the rules, regulations and policies in effect at the time the <br /> Development Agreement was entered into. <br /> The Planning Commission heard this matter at its meeting of <br /> March 17, 1988. After considering all written and oral <br /> testimony, the Commission, by a vote of 6-0, recommended <br /> approval of the Planning Title Text Amendment. <br /> BOS LETTER PAGE 1 <br />
