(e) fe-}- Parcels for Dwellings on Same Lot. Two (2) <br /> parcels, each containing one (1) habitable <br /> single-family dwelling and each consisting of <br /> less area than the minimum area required in <br /> Table 9-610.2, may be created from an original <br /> parcel for the purpose of providing a separate <br /> lot for each dwelling, subject to the <br /> following conditions: <br /> (1) The single-family dwellings were erected prior <br /> to February 9, 1961; and <br /> (2) The proposed subdivision of property complies <br /> with Sections 51230.1 and 66474.4 of the <br /> Government Code if the property to be divided <br /> is under a Williamson Act contract. <br /> (f) Parcels Based on Lot-Size Averaging. Parcels <br /> of land containing up to ten (10) percent less <br /> area than the minimum area required in Table <br /> 9-610.2 may be created from an original <br /> parcel, subject to the following conditions: <br /> (1) The overall average parcel area of the <br /> proposed subdivision is equal to or greater <br /> than the minimum parcel area required in Table <br /> 9-610.2; and <br /> (2) The proposed subdivision of property complies <br /> with Sections 51230. 1 and 66474.4 of the <br /> Government Code if the property to be divided <br /> is under a Williamson Act contract. <br /> Section 2. The intent of this ordinance is to continue to <br /> permit farm families to create homesite parcels in agricultural <br /> areas and to limit the number of homesite parcels which in the past <br /> were often created for purpose of sale. - This ordinance presents <br /> objective standards for the creation of homesite parcels to prevent <br /> past abuses under previous ordinances which permitted landowners to <br /> present false reasons for the creation of homesite parcels. This <br /> ordinance limits the number of homesite parcels in an attempt to <br /> prevent the fragmentation of agricultural land and to encourage the <br /> preservation of agricultural land. <br /> Section 3. Applications for homesite parcels filed prior to <br /> 5 : 00 p.m. , November 9 , 1993 , shall be approved under Section 9- <br /> 610. 3 as it read prior to this Amendment. <br /> TA-93-3 -5- ORD 3761 <br />
