STAFF REVIEW DRAFT (7/8/93) <br /> AN ORDINANCE AMENDING TITLE 9 OF THE ORDINANCE CODE OF <br /> THE COUNTY OF SAN JOAQUIN RELATIVE TO SECTION 9-610 . 3 <br /> CONCERNING HOMESITE PARCELS IN THE GENERAL AGRICULTURAL (AG) <br /> ZONE. <br /> THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN <br /> ORDAINS AS FOLLOWS: <br /> Section 1. Section 9-610. 3 , Chapter 9-610, Division 6, <br /> Title 9 of the San Joaquin County Ordinance Code is hereby <br /> amended by amending subsection (a) , to read as follows: <br /> Section 9-610. 3 Area Exceptions. The following <br /> exceptions to the minimum lot area regulations in Table <br /> 9-610. 2 are permitted: <br /> (a) Homesite Parcels. Homesite parcels may be <br /> approved in the AG zone to finance or refinance a <br /> residence provided -i€ all of the following <br /> ��erconditions are met satisfied: <br /> (1) The number ef parreels rresulmoj:nq frem the <br /> mien-dees-fl-et emeeed the _mam±mu-mb f <br /> p•areems—germissible u-dt,,e-6ene±- : Plan <br /> deter T eale�at ing—The--ter e f <br /> the date of adeptren e f this b t; er shall_ <br /> be determine Not more than one (1) homesite <br /> parcel may be created from an existing parcel; <br /> (2) The A4rl homesite parcels shall contain--a <br /> m±ni -e€ not less than two (2) acres nor <br /> more than five (5) acres; <br /> (3) Neither the homesite parcel nor the <br /> remainder parcel may be voluntarily <br /> transferred separately from the other parcel ; <br /> however, if a commercial lender forecloses on <br /> either parcel either parcel may be <br /> transferred separately; <br /> (4) Upon repayment of the loan, or upon <br /> repayment of any loan to refinance the loan, <br /> the then owner of the homesite parcel shall <br /> merge the homesite parcel with the remainder <br /> parcel as provided for in this Title, unless <br /> the owner of the homesite parcel acquired the <br /> homesite parcel through foreclosure; <br /> (5) The remainder parcel shall remain a non- <br />
