ORDINANCE NO. <br /> AN ORDINANCE AMENDING TITLE 9 OF THE ORDINANCE CODE OF THE COUNTY OF SAN <br /> JOAQUIN RELATIVE TO SECTION 9-610.3 CONCERNING HOMESITE PARCELS IN THE GENERAL <br /> AGRICULTURAL (AG) ZONE. <br /> THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN ORDAINS AS FOLLOWS: <br /> Section 1. Section 9-610.3, Chapter 9-610, Division 6, Title 9, of the San Joaquin County <br /> Ordinance Code is hereby amended by amending Subsection (a) to read as follows: <br /> Section 9-610.3 Area Exceptions. The following exceptions to the minimum lot area regulations <br /> in Table 9-610.2 are permitted: <br /> (a) Homesite Parcels. Homesite parcels may be approved in the AG zone to finance or <br /> refinance a residence, provided it all of the following criteria conditions are Mot satisfied: <br /> (1) ThQ P, <br /> of PwGqls� all divisioAr.Of 4h@ PFOPOny#QFA the date of aGloption of this <br /> Not more than one (1) homesite parcel may be <br /> created from an existing parcel; <br /> (2) The AA homesite parcels shall contain _2 miaia�m lot not less than two (2) acres <br /> nor more than five (5) acres; <br /> Qj Neither the homesite parcel nor the remainder parcel may be voluntarily <br /> transferred separateN from the other parcel; however, if a commercial lender <br /> forecloses on either parcel either parcel may be transferred separately; <br /> �Aj Upon repayment of the loan or upon repayment of any loan to refinance the <br /> loan the owner of the homesite parcel shall merge the homesite parcel with the <br /> remainder parcel as provided for in this Title unless the owner of the homesite <br /> parcel acquired the homesite parcel through foreclosure; <br /> J�j The remainder parcel shall remain a non-buildable site for primary dwelling units; <br /> said parceira, GoFpp�y with 'QQQt0QA2 542-3Q.4 and 664:74.4 of the <br /> prom <br /> Homesite and remainder parcels <br /> application approved under the provisions of this Subsection shall have a notice recorded <br /> bV separate instrument concurrently with the parcel map to indicate the restrictions. A <br /> note shall also be placed on the parcel map indicating the restrictions with a reference <br /> to the instrument number of said recorded notice The restrictions specified in <br /> Subsection (a) shall terminate if the subject property is reclassified to a residential zone <br /> or to an agricultural zone with a five (5) acre minimum. <br /> Section 2. This Ordinance shall take effect and be in force thirty (30) days after its adoption, and <br /> prior to the expiration of fifteen (15) days from the passage thereof, shall be published once (1) in the <br /> TA-93-3 - 1 - (7-29-93) <br />
