Attachment to Application - Appeal
of Planning Commission Action
William and Ann Potter
b. The Commission determined that Finding No. 2 (no special
privileges) could not be made. The owners disagree with
this finding for the following reasons.
First, as stated above, there are many pre-existing, non-
conforming parcels in the area. Creation of these two
parcels will not stick out as a "special privilege, " given
the area' s numerous similar parcels.
Second, the Staff and Commission statement that "other
properties in the vicinity cannot create parcels that exceed
General Plan densities" is not pertinent to this situation.
This subdivision will not in any way change the current
densities or uses which already exist. In other words, the
property will continue to be used in the same lawful manner
as it is used now. Therefore, there won't be any "special
privilege, " such as creating another non-conforming building
site or a higher residential density.
Third, the surrounding owners all support this project, as
set forth in their letters (attached to the original
Application) . Thus, even the neighbors agree that this
subdivision will not grant any "special privileges. "
-6-
