Attachment to Application - Appeal <br /> of Planning Commission Action <br /> William and Ann Potter <br /> b. The Commission determined that Finding No. 2 (no special <br /> privileges) could not be made. The owners disagree with <br /> this finding for the following reasons. <br /> First, as stated above, there are many pre-existing, non- <br /> conforming parcels in the area. Creation of these two <br /> parcels will not stick out as a "special privilege, " given <br /> the area' s numerous similar parcels. <br /> Second, the Staff and Commission statement that "other <br /> properties in the vicinity cannot create parcels that exceed <br /> General Plan densities" is not pertinent to this situation. <br /> This subdivision will not in any way change the current <br /> densities or uses which already exist. In other words, the <br /> property will continue to be used in the same lawful manner <br /> as it is used now. Therefore, there won't be any "special <br /> privilege, " such as creating another non-conforming building <br /> site or a higher residential density. <br /> Third, the surrounding owners all support this project, as <br /> set forth in their letters (attached to the original <br /> Application) . Thus, even the neighbors agree that this <br /> subdivision will not grant any "special privileges. " <br /> -6- <br />
