SECTION 9-852 .1 INTENT. The intent of this Chapter is to provide a <br /> method for allowing the removal of excess material from property in <br /> order to establish ponds for water supply or for recreational <br /> purposes while protecting people, property, agriculture and the <br /> environment from impacts caused by the pond excavation. <br /> SECTION 9-852 .2 PERMITTED ZONES. Applications for Pond Excavation <br /> Permits may be accepted in the AG zone. <br /> SECTION 9-852 .3 REQUIREMENTS FOR APPLICATION. An application for a Pond <br /> Excavation Permit shall include the following: <br /> (a) A Certified Grading Plan prepared by a registered civil <br /> engineer; <br /> (b) An Operational Statement; <br /> (c) A soils report prepared by a soil scientist qualified to <br /> analyze agricultural soils , ; and <br /> (d)_ A fee as specified by resolution of the Board of <br /> Supervisors. <br /> SECTION 9-852 . 4 REVIEW PROCEDURES. The review procedure for a Pond <br /> Excavation Permit Application shall be the Public Hearing <br /> Procedure as set forth in Chapter 9-220 . <br /> SECTION 9-852 . 5 FINDINGS Prior to approving an application for a <br /> Pond Excavation Permit the Review Authority shall find all of the <br /> following true: <br /> (a) The pond is located on non-prime soil or the proposed <br /> site contains a unique environmental or aeoaraphic <br /> feature that will be retained and preserved as a result <br /> of the nroiect, <br /> (b) The excavation will not have a detrimental effect on any <br /> surrounding agricultural lands ; <br /> (c) Issuance of the permit shall not be significantly <br /> detrimental to the public health, safety, or welfare, or <br />
