Eight Mile Rd. <br /> Stockton, CA 95212 <br /> The State Water Resources Control Board (SWRCB) has responded to our request for clarification of the <br /> eligibility for SB 2004 Cleanup Fund of previously exempt farm tank owners. l'Ericlosed is a copy of the <br /> SWRCB letter and a copy of our letter to SWRCB requesting clarification of farm tank eligibility. <br /> As noted in the letter, recent legislation (AB 1699) placed conditions on SB 2004;eligibility which are <br /> retroactive to January 1, 1985. Specifically the letter states that whether or not farm tank owners complied <br /> with closure and operating permit requirements when they discontinued use'�of a.hank for agricultural <br /> purposes, they are not eligible for the Fund if the tank was located on agricultural'property on or after <br /> January 1, 1985. The letter further states that a change,in the law would be required in order to allow tank <br /> owners in your situation to participate in the Cleanup Fund. <br /> It is our recommendation that you contact your legislative representatives and request their assistance in this <br /> matter.
