I the State of California and confined to Defendant's EQUIPMENT RENTAL activities in the County 2 of San Joaquin and elsewhere in the State of California. 3 3. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they 4 are doing business in the State of California, in the course of Defendant's EQUIPMENT RENTAL 5 activities, are pursuant to Health and Safety Code section 25181 hereby permanently enjoined from: 6 a. Failing to submit a written response relating to the received inspection report to the 7 authorized local agency within the required timeframe, in violation of Health and Safety Code 8 section 25185(c)(3); 9 b. Storing hazardous waste onsite longer than one hundred eighty(180) days, in 10 violation of California Code of Regulations,title 22 section 66262.34(d); 11 c. Failing to completely label or mark each container or portable tank used for onsite 12 accumulation of hazardous waste, in violation of California Code of Regulations,title 22 section 13 66262.34(f); 14 d. Failing to maintain and operate facility to minimize the possibility of a fire, 15 explosion, or any unplanned sudden or non-sudden release of hazardous waste, in violation of 16 California Code of Regulations,title 22 section 66265.31; 17 e. Failing to test and maintain all facility conununications or alann systems, fire 18 protection equipment, spill control equipment, and decontamination equipment, in violation of 19 California Code of Regulations, title 22 section 66265.33; 20 £ Failing to retain a copy of each signed manifest for three (3) years or until the 21 generator receives a signed copy from the designated facility which received the waste, in violation 22 of California Code of Regulations,title 22 section 66262.40(a); and 23 g. Failing to keep a record of each shipment of universal waste received at the 24 universal waste handler's facility,in violation of California Code of Regulations, title 22 section 25 66273.39(a). 26 4. Defendant with actual or constructive knowledge of this Injunction, only in so far as they 27 are doing business in the State of California,in the course of Defendant's EQUIPMENT RENTAL 28 activities, are pursuant to California Business and Professions Code, section 17204 hereby -2- PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
