I the State of California and confined to Defendant's EQUIPMENT RENTAL activities in the County <br /> 2 of San Joaquin and elsewhere in the State of California. <br /> 3 3. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they <br /> 4 are doing business in the State of California, in the course of Defendant's EQUIPMENT RENTAL <br /> 5 activities, are pursuant to Health and Safety Code section 25181 hereby permanently enjoined from: <br /> 6 a. Failing to submit a written response relating to the received inspection report to the <br /> 7 authorized local agency within the required timeframe, in violation of Health and Safety Code <br /> 8 section 25185(c)(3); <br /> 9 b. Storing hazardous waste onsite longer than one hundred eighty(180) days, in <br /> 10 violation of California Code of Regulations,title 22 section 66262.34(d); <br /> 11 c. Failing to completely label or mark each container or portable tank used for onsite <br /> 12 accumulation of hazardous waste, in violation of California Code of Regulations,title 22 section <br /> 13 66262.34(f); <br /> 14 d. Failing to maintain and operate facility to minimize the possibility of a fire, <br /> 15 explosion, or any unplanned sudden or non-sudden release of hazardous waste, in violation of <br /> 16 California Code of Regulations,title 22 section 66265.31; <br /> 17 e. Failing to test and maintain all facility conununications or alann systems, fire <br /> 18 protection equipment, spill control equipment, and decontamination equipment, in violation of <br /> 19 California Code of Regulations, title 22 section 66265.33; <br /> 20 £ Failing to retain a copy of each signed manifest for three (3) years or until the <br /> 21 generator receives a signed copy from the designated facility which received the waste, in violation <br /> 22 of California Code of Regulations,title 22 section 66262.40(a); and <br /> 23 g. Failing to keep a record of each shipment of universal waste received at the <br /> 24 universal waste handler's facility,in violation of California Code of Regulations, title 22 section <br /> 25 66273.39(a). <br /> 26 4. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 27 are doing business in the State of California,in the course of Defendant's EQUIPMENT RENTAL <br /> 28 activities, are pursuant to California Business and Professions Code, section 17204 hereby <br /> -2- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
