Stockton December 2.3, 2019 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 113 HSC 25160.2(b)(3)Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: Copies of consolidated manifest receipts from December 23,2016-December 23,2019 for <br /> hazardous wastes including metal fines, oily absorbent(including oil filters), and used oil were not found on site <br /> during the inspection. <br /> In addition, Department of Toxic Substance Control records indicate that used oil(400 gallons,state waste code <br /> 221)was picked up on August 17,2017,on a consolidated manifest. The consolidated manifest was not available <br /> for review. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts from December 23, <br /> 2016-December 23,2019 and maintain them on site. Provide a copy of the missing consolidated manifest receipts, <br /> a copy of the missing consolidated manifest from August 17,2017,and a corrective action statement to the San <br /> Joaquin County Environmental Health Department. <br /> This is a Class II violation. <br /> Ito 3 CCR 66262.34(d)(2)Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> OBSERVATION:The following open hazardous waste storage containers were observed on-site in the outside area: <br /> -One black 55 gallon steel drum containing oily debris and a used metal oil filter was missing a ring for the lid. <br /> -One blue 5 gallon plastic bucket containing metal fines with cutting fluid was missing a lid. <br /> In the wash bay area,two plastic 5 gallon buckets containing oily debris were missing lids. <br /> In the main maintenance shop,one bin containing hydraulic hoses and metal fines saturated with used oil was <br /> missing a lid. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage,except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately close these containers and ensure all hazardous waste containers are closed <br /> when not adding or removing waste.
