Struchtemeyer
Senior Vice President, Production
The Marley Cooling Tower Company
P.O. Box 2912
Mission, Kansas 66201
Dear Mr. Struchtemeyer:
The review of your proposed corrective action plan has convinced the
Department of Health Services that this matter can no longer be han-
dled as an informal settlement agreement, and that legal action must
be taken. We have therefore referred the matter to the San Joaquin
County District Attorney for appropriate action. Mr. Stephen Taylor,
Deputy District Attorney will be representing the Department in the
future. We have transmitted to Mr. Taylor the enclosed minimum con-
ditions which the Department will now accept. Past discussions with
regard to penalties are of course no longer operative and are now
within the jurisdiction of the San Joaquin County Superior Court.
Sincerely,
v. % I
Gilbert Jensen
Enforcement Coordinator
Program Management Section
Toxic Substances Control Division
Enclosure
cc: Stephen E.
