The following observa- <br /> tions we made during the inspection: <br /> Recent spillage of what appeared to be treatment chemical solution from <br /> the retorts was observed on the floor of the retort pit adjacent to the <br /> metal collection boxes. <br /> There was staining on the soil floor of the retort pit in the area of <br /> the pumps, on the east side of the pit. <br /> There was a hole in the floor of the retort pit at about the center of <br /> the pit. <br /> There was staining at the base of the retention wall on the north side of <br /> the tank area near the drain for the area. This may be due to leakage <br /> through the retention wall. <br /> The percolation pond was earthen lined and there appeared to be some dark <br /> staining of the soil along the water line. <br /> VI. Violations <br /> A. Health and Safety Code (H&SC) Division 20, Chapter 6.5 <br /> 1. Section 25154 - The Marley Cooling Tower Company (Marley) unlaw- <br /> fully handled, stored, and disposed of hazardous waste. <br /> 2. Section 25159.6 - Marley is not complying with regulations adopted <br /> by the United States Environmental Protection Agency, of Public <br /> Law 84-580, as amended, within the meaning described in Section <br /> 25159.6. <br /> 3. Section 25189(b) - Marley intentionally and negligently violated <br /> provisions of this Chapter. <br /> 4. Section 25189(d) - Marley negligently disposed of and caused the <br /> disposal of hazardous waste at a point which is not authorized <br /> according to the provisions of the Chapter. <br /> 5. Section 25189.5(a) - Marley disposed of and caused the disposal <br /> of hazardous waste at a point which is not authorized according <br /> to the provisions of the Chapter. <br />
