Pursuant to that finding, EHD requestea that MCD "submit a letter to this <br /> agency within 20 calendar days of receipt of this-notice which identifies all current. <br /> record owners of fee title." <br /> Contrary to EHD's assertion, MCD is not a responsible party for.the <br /> underground storage tank (UST) closures at 1800 North`Marshal Avenue or-at <br /> 2801 West Lane. l <br /> MCD did not`-install-the USTs. MCD has ncver owned-'the USTs. MCD did not <br /> operate the USTs. And_MCD did not remove the USTs. Accordingly, MCD is not a. <br /> responsible party under Federal or California statue or regulation for these USTs: <br /> Further, MCD acquired the properties at 18 DO North Marshal Avenue and <br /> 2801 West Lane out of bankruptcy on May 2, 2006. Prior to the acquisition transaction <br /> MCD performed All-Appropriate Inquiry_ due diligence pursuant to the ASTM El 527- <br /> 00 standard, qualifying MCD for bona fide prospe tive purchaser (BFPP) immunity <br /> from liability under CERCLA. 42 USC § 9607(q)(1)(A). These due diligence <br /> documents include a Phase I Environmental Site Assessment dated August 7, 2003 by <br /> Geologica. <br />
