The following is an itemized list of hazardous waste violations that have not been <br /> addressed for PANELLA TRUCKING LLC as of December18, 2019. <br /> Open violations from October 29, 2019 inspection <br /> Violation #118-Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: Copies of consolidated manifest receipts from 2/6/2019, 3/21/2019 and 4/22/2019 for hazardous <br /> wastes including used oil were not found on site during the inspection <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts from 2/2019 to 4/2019 and <br /> maintain them on site. Provide a copy of the consolidated manifest receipts and a corrective action statement to the <br /> San Joaquin County Environmental Health Department. <br /> ❑ This violation was corrected ❑ This violation will be corrected by (date): <br /> ❑ Supporting documents included <br /> Describe actions taken or will be taken to correct violation: <br /> Violation #507 -Failed to conduct daily inspections of hazardous waste tank system and maintain records <br /> onsite. <br /> OBSERVATION The facility has a hazardous waste tank but does not have three years of complete daily tank <br /> inspection records. No daily hazardous waste tank inspection records were available for review during the <br /> inspection. <br /> REGULATION GUIDANCE: (a)The owner or operator shall inspect, where present, at least once each operating <br /> day: <br /> (1) overfill/spill control equipment (e.g., waste-feed cutoff systems, bypass systems, and drainage systems) to <br /> ensure that it is in good working order; <br /> (2)the aboveground portions of the tank system, if any, to detect corrosion or releases of waste; <br /> (3) data gathered from monitoring equipment and leak-detection equipment, (e.g., pressure and temperature <br /> gauges, monitoring wells) to ensure that the tank system is being operated according to its design; <br /> (4) the construction materials and the area immediately surrounding the externally accessible portion of the tank <br /> system including secondary containment structures (e.g., dikes)to detect erosion or signs of releases of hazardous <br /> waste (e.g., wet spots, dead vegetation); and <br /> (5)for uncovered tanks, the level of waste in the tank, to ensure compliance with section 66265.194(b)(3). <br /> (c) The owner or operator shall document in the operating record of the facility an inspection of those items in <br /> subsection (a) of this section. <br /> CORRECTIVE ACTION: Immediately start conducting and documenting complete daily hazardous waste tank <br /> inspections. Provide a corrective action statement and supporting documentation to the San Joaquin County <br /> Environmental Health Department(EHD) within 30 days. <br /> Page 3 of 4 <br />
