It is being proposed, therefore, that your claim be removed from the <br /> Priority List based on the following reason: <br /> Section 281 l(b)(3) of the UST Cleanup Fund Regulations requires that you remain in <br /> compliance with corrective action directives issued by the local regulatory agency. On March <br /> 24, 1998, Fund staff completed a detailed review of your claim at the San Joaquin County <br /> Environmental Health Department and you were deemed out of compliance with their directives. <br /> On February 20, 1998, the San Joaquin County Environmental Health Department sent you a <br /> `90-day Compliance Letter.' The letter listed directives you must meet to continue your <br /> eligibility for reimbursement of cleanup costs from the UST Cleanup Fund. To date, these <br /> directives have not been completed. <br /> If you disagree with this Staff Decision, you may either request review and reconsideration by <br /> the Program Manager or you may formally appeal the decision and request a Division Decision <br /> from the Chief of the Division.
