The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System(CERS) annually for 2018, 2019, and 2020. The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. Documentation showing initial and annual refresher training of 1. Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency; 2. Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment; and 3. Evacuation plans and procedures, including immediate notice, for the business site; was not available at the time of inspection. The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice, for the business site. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years. Immediately provide employee training for appropriate personnel and submit a copy of the training records to the EHD. This is a repeat violation, Class Il. 12 HSC 25505(c) Failed to have the business plan readily available to facility or EHD personnel. Facility could not provide the Emergency Response Plan and the Chemical inventory upon request. The emergency response plans and procedures, the inventory of information required by this article, and the site map required by this section shall be readily available to personnel of the business or the unified program facility with responsibilities for emergency response or training pursuant to this section. Immediately make arrangements to have the business plan readily available for review. This is a Class II violation. Overall Inspection Comments: An inspection report was provided to the facility operator on the day of inspection, June 18th. On June 22nd, the report was amended by the EHD. This amended report replaces the initial report. The report was amended to add the narrative to for violation 9.
