• In the "Cultural Resources" section the work of Dr. James <br /> Bennihof is extensively referenced. He sent a copy of the EIR <br /> D18 to Dr. Benahof. This is a significant archaeological site, <br /> and not enough is known about the site to accurately gauge how <br /> significant are the resources contained within the Tracy Lakes <br /> complex. It is imperative to conduct a full archaeological <br /> study of the site before the project is approved. <br /> • In the "Cultural Resources,, section there is a reference about <br /> identified human remains. He wondered if CEQA Health and <br /> Safety Code Section 7050.5 has been violated by the developers <br /> at the project site. In regard to human remains, CEQA <br /> D19 Appendix K, Section 8, states, "In the event of discovery or <br /> recognition of any human remains in any location other than a <br /> dedicated cemetery, there shall be no further excavation or <br /> disturbance of the site or any nearby area reasonably <br /> suspected to overlie adjacent human remains. " The cutting <br /> down of thousands of oaks in the riparian forest and the <br /> subsequent stump removal may have violated the above <br /> requirements. <br /> Pam Muick (P. O. Box 7811, Berkeley) , a consultant for Robertson <br /> Homes/Catwil Corporation: <br /> She was hired to address concerns about land management and <br /> oak ecology, preservation, and restoration on the site. She <br /> wrote the Vegetation Management section of the Management <br /> D20 Plan. She said when she read the first EIR it was apparent <br /> that the Management Plan had not been read. However, comments <br /> were subsequently incorporated. In the next 20 years, 1/4 <br /> million acres of oak woodlands are expected to be developed in <br /> California. <br /> Joe DiCristina, a vice president with Catwil Corporation: <br /> He said he was also surprised that the Management Plan was not <br /> D21 referred to more succinctly in the EIR. <br /> Jerald Johnson (P. O. Box 230, Newcastle) , Professor of <br /> Anthropology at California State University, Sacramento: <br /> He has several concerns about the adequacy of the work done by <br /> the consultants, Mills & Associates. <br /> He saw Brovelli Woods in the 1960 ' s before the leveling was <br /> F- done. He went out there again recently and collected soil <br /> D22 samples. He found cultural resources that were unrecorded by <br /> the project archaeologist.
