D 119: This information is noted. <br /> D 120: Human encroachment will bring noise into the solitude of this site. Wildlife can adapt to noise <br /> and human presence. For example, in the suburban/rural fringe, particularly in the Bay Area, <br /> deer have become very accustomed to humans and the noise emanating from machines. We <br /> concur that the tranquility of the site will be lost. <br /> D121: Comments acknowledged. <br /> D 122: The revised biological study and cultural resources study were prepared independently without <br /> the benefit of providing an analysis of the potential mitigation impacts. The EIR has been <br /> revised to reflect potential conflicts in Volume 11. Refer to Sections 4.7 and 6.5. <br /> D 123: Comment acknowledged. See response C12 for a discussion of possible conflicts between <br /> biological mitigation measures and archaeological sites. <br /> D 124: When the Draft EIR was prepared in fall 1991, impacts and mitigation measures were based on <br /> a brief exposure to the site during the fall months. There was no choice but to assume the <br /> worse-case scenarios in the absence of field data and recommend essentially no project for the <br /> area. Once the consulting biologists were able to observe how the lakes function in a moderate <br /> rainfall year,compared to how they function during drought years, a compromise plan that would <br /> ensure winter water impoundment in South Tracy Lake, no matter what drought conditions may <br /> prevail, appeared a workable mitigation measure for the site. It must be remembered that the <br /> mitigation process requires that both the needs of an applicant and the requests of conservation <br /> agencies be fairly addressed, and rarely does either side achieve all or even most of their goals. <br /> D 125: Refer to CDFG response B7. <br /> D 126: Refer to CDFG response B6. <br /> D127: CDFG guidelines and regulations will dictate the mitigation measures for this species. <br /> D 128: CDFG guidelines and regulations will dictate the mitigation measures for this species. <br /> D 129: If the woods are preserved, new woodland is purchased to offset the loss of preliminary fairway <br /> construction,and the grassland is restored to a more productive rodent/rabbit habitat,then YES, <br /> a "net benefit" would be achieved. <br /> D 130: When the lakes are allowed to function normally without drainage during normal and above <br /> normal years, and fall rains begin in earnest by early November,then they will retain moderate <br /> impoundments of water throughout the year. <br /> D131: Comments noted. <br /> D 132: According to a strict interpretation of the 1929 Migratory Bird Conservation Act, the commenter <br /> may be correct. In the EIR biologist's opinion,the loss of these historical waterbird wintering <br /> and breeding grounds cannot be adequately mitigated. <br /> VI-165 <br />
