B. FINDING: CANCELLATION IS CONSISTENT WITH THE PURPOSES
OF THE WILLIAMSON ACT
1. The cancellations are for lands on which notices of non-
renewal have been termed pursuant to Section 51245 of the
Government Code.
1. 1 The Board finds that pursuant to Sections 51245 and
51282 (b) (1) , Notice of Non-Renewal of Williamson Act Contract was
served on the County as follows:
Name Contract No. Date Acreage
Buckeye Ranch L.P. 75-C1-111 April 28, 1993 336.5
2 . THE CANCELLATION IS NOT LIKELY TO RESULT IN THE REMOVAL
OF ADJACENT LANDS FROM AGRICULTURAL USE, BECAUSE
2 . 1 The land subject to the cancellation request is
distinctly different from the adjacent lands in agricultural use
in that it is heavily forested in part, periodically subject to
inundation as lake bottom in part, and otherwise not developed as
irrigated agricultural land. In fact, the land subject to the
cancellation request has never been utilized or developed for
irrigated agriculture in stark contrast to the surrounding lands,
all of which are developed and utilized for irrigated agriculture.
2 . 2 All proposed residential sites are set back far
enough from adjacent agricultural uses to avoid any restriction
upon or conflict with continuing agricultural use of adjacent
properties, the nearest proposed residential use to any adjacent
agricultural use (irrigable pasture) being over 100 yards distant,
Wm Act Cancellation —8—
June
8—
June 8, 1993
