Hazelton Avenue <br /> Stockton, CA 95205 <br /> Dear Ms. Sullivan: <br /> Staff of the State Lands Commission (SLC) has received the Notice of Preparation <br /> (NOP) for the Buckeye Ranch Environmental Impact Report (EIR), SCH #91012103, and <br /> provide the following comments. <br /> The SLC has jurisdiction over nearly 4 million acres of sovereign land underlying the <br /> State's navigable waterways. Such lands include, but are not limited to, the beds of more <br /> than 120 navigable rivers and sloughs, nearly 40 navigable lakes, and the 3 mile wide band <br /> of tide and submerged lands adjacent to the coast and offshore islands of the State. The <br /> SLC holds its sovereign interest in these lands subject to the Public Trust for commerce, <br /> navigation, fisheries, open space, and preservation of natural environments, among others. <br /> The proposed project area includes sovereign lands, as described above, of the State <br /> of California. Such lands include the Mokelumne River and may include Jahant Slough and <br /> Tracy Lake. The SLC has a legal responsible for, and a strong interest in, protecting the <br /> ecological and Public Trust values associated with the State's sovereign lands, including the <br /> use of these lands for habitat preservation, open space and recreation, among others. <br /> Proposed developments located within these waterways, such as the bridge crossing the <br /> Mokelumne River, are subject to the SLCs permitting process. The Commission is <br /> therefore a Responsible Agency under the California Environmental Quality Act (CEQA). <br /> Additionally, if development indirectly affects lands or resources under the jurisdiction of <br /> the SLC, the Commission would be a Trustee Agency under the (CEQA). <br /> The SLC is particularly concerned with the natural resources and public recreational <br /> opportunities associated with the Mokelumne River. We are concerned that the <br /> environmental review and decision-making processes of all agencies take into account the <br /> impacts that projects may have on public trust resources in and along the State's waterways. - <br /> These resources include, but are not limited to, riparian habitat, fish and wildlife, and the <br /> beds of the rivers themselves. <br />
