Such an assumption could only be invalidated by a spring-summer survey to document <br /> Swainson's hawk foraging patterns in the project site area. <br /> Mitigation Measure <br /> 4.7-1(a) Redesign the development to position the 26 homesites as far away as possible <br /> from the Brovelli Woods Swainson's hawk nesting habitat and presumed <br /> productive foraging habitat such as the Tracy Lakes shoreline area and lakebed. <br /> 4.7-1(b) Eliminate the golf course. <br /> 4.7-1(c) Eliminate the proposed private access road to Davis Road which would further <br /> impact the Brovelli nesting area. <br /> 4.7-1(d) Realign the segment of the equestrian trail which extends through Brovelli Woods <br /> to the outside edge of the woodland. <br /> 4.7-1(e) In accordance with Section II-3-B-c of the CDFG Mitigation Guidelines for the <br /> Swainson's hawk, (Appendix F) purchase and dedicate for preservation a <br /> minimum of 12.5 acres off-site of prime mature riparian forest within the Dry <br /> Creek Swainson's hawk subpopulation area to replace the 12.5 acres previously <br /> cleared. It should be noted that the restoration project presently underway in the <br /> south central part of the site cannot be considered adequate mitigation for the <br /> loss of critical Swainson's hawk nesting habitat because it would take at least SO <br /> years for such a stand of young oak sapling to grow to the size required for <br /> nesting by this species. The purpose of the Endangered Species Act is to <br /> preserve critical habitat now, as opposed to providing more in the future when <br /> the species could very well be extinct within the region in question. <br /> 4.7-1(f) Retain an expert in raptor ecology to study the current state of Brovelli Woods <br /> and develop a habitat enhancement plan for the recently cleared 12.5-acre <br /> riparian woodland community. Upon approval by CDFG, the plan should be <br /> implemented and monitored for a minimum of five years. The developer should <br /> be responsible for the cost of restoration. <br /> 4.7-1(g) Prohibit use of rodenticides on the entire project area. The applicant's <br /> integrated pest managementplan should include measures for controlling rodents <br /> without the use of chemical applications. <br /> 23 <br />
