SONE BAND OF MIWOK <br /> Mokelumne-Locolumne Tribe <br /> 2-91-9 .Jackson Valley-RoaG, Ione, GA, 95640- - <br /> (209) 274-2915 Phone/Fax <br /> Nicolas Villa, Jr,, Chief-lappo Loren Hill, Moo-Chief Barbara Hill, Soo,/Treasurer Joan Villa, Tribal Adminstrator <br /> January 13, 1992 <br /> San Joaquin County <br /> Board of Supervisors <br /> Stockton, Ca. <br /> Re: Tribal Jurisdiction in relationship to Buckeye Ranch, <br /> Golf Course and Nature Preserve. <br /> Chairman and Members, <br /> It has been brought to the attention of the Ione Band of <br /> Miwok Indians, Mokelumne-Locolumne Tribe, a federally <br /> recognized tribal sovereign entity, the intent to develop <br /> an area known as Brovelli Woods. <br /> Members of the Tribe met yesterday with staff of the <br /> Planning Department and archaeologists familiar with the <br /> area. <br /> This letter is to advise San Joaquin County and the <br /> developer of the proposed project, Catwil Corporation, <br /> Robertson Homes and its agents that the Ione Band of Miwok <br /> Indians, Mokelumne-Locolumne Tribe having jurisdiction <br /> over its members thus having jurisdiction over its <br /> ancestors, hereby asserts its authority over its <br /> aboriginal territories which include, but are not limited <br /> to the Buckeye Ranch Project over San Joaquin County <br /> regarding the preservation and protection of burial sites, <br /> associated burial goods, unassociated burial goods, sacred <br /> objects and sacred sites as defined in P.L. 101-601, 25 <br /> USC 2002, known as the Native American Graves Protection <br /> and Repatriation Act signed into law by President Bush, <br /> November 16, 1990, regulated and implemented by execution <br /> of Federal Contracts April 4, 1992 under Tribal Law of the <br /> Ione Band of Miwok Indians. (the Act) (Tribal land is <br /> aboriginal tribal land as defined in Dan v. United States, <br /> Cite 404 A 2d 555 May 1979, cert. denied 444 US 1098 <br /> 1980) . <br /> As described within the Act, the Tribe will require a <br /> Memorandum of Agreement between the lead agency, the <br /> developer and the Tribe before any further approvals can <br /> be given. <br /> -1- <br />
