Staff Recommended Condition of Approval: <br /> 23. A qualified archaeologist who is acceptable to the Native American Community, <br /> and a qualified Native American monitor shall both be present during all subsurface <br /> work. <br /> Amended Condition of Approval: <br /> A qualified archaeologist and a qualified Native American monitor shall both be present <br /> during subsurface work within 100' of the archaeologically sensitive areas delineated in <br /> the BioSystems November 1992 report. <br /> Staff Recommended Condition of Approval: <br /> 24. All construction and grading activities shall cease immediately upon the discovery <br /> of cultural resource materials. Such work shall cease until the developer has <br /> complied with the requirements of Appendix K of the CEQA Guidelines. <br /> Amended Condition of Approval: <br /> If previously undisclosed archaeological resources are encountered during construction <br /> of any portion of the project,work in the area of the discovery will cease. The discovered <br /> property will be examined by a qualified professional archaeologist,recorded according <br /> to accepted contemporary standards, and the impacts to the site, if any, must be <br /> identified to determine the probability limits and importance of the resource. Such an <br /> evaluation may require limited subsurface investigation. <br /> If the discovery involves human remains, applicant will comply with Health and Safety <br /> Code 7050.5 and Public Resources Code 5097. Project work may continue outside <br /> known archaeological resources. <br /> Applicantwill consult with the San Joaquin County Planning Commission,and appropriate <br /> and interested Native American Groups,to develop a plan that will ensure the avoidance, <br /> protection, or scientific and respectful removal of the identified archaeological remains <br /> prior to continued project development in the area of the discovery. <br /> Staff Recommended Condition of Approval: <br /> 25. Areas of high archaeological sensitivity (shown on Figure 4.9-3 of the Final EIR) <br /> shall be fenced during construction. <br /> Amended Condition of Approval: <br /> Areas of high archaeological sensitivity (depicted in the BioSystems November 1992 <br /> Report) shall be fenced during construction. <br /> 4 <br />
