Development Committee -3- <br /> note that based on the complexity of the proposed project, as <br /> well as of the impacts related to the project, both the suggested <br /> Conditions of Approval and "Findings of Environmental <br /> Significance" may be modified during the next few days while the <br /> Staff Report is being prepared. <br /> As the recommended Conditions of Approval will, if approved, <br /> result in a drastically different project then is envisioned by <br /> the applicant, it is expected that the applicant may wish to <br /> challenge the adoption of the recommended condition and Findings <br /> of Environmental Significance. Should this be the case, it is <br /> recommended that the applicant prepare alternative "Findings of <br /> Environmental Significance" based on alternative mitigation <br /> measures that they are proposing. These materials will be <br /> included with the Staff Report packets mailed to each Planning <br /> Commissioner, providing that they are submitted to this office no <br /> later than noon, on Friday, July 30, 1993 . <br /> Recommendation: <br /> The Development Services Division will be recommending that the <br /> Quarry Excavation component of the project be denied based on the <br /> above discussion; and, if the Board of Supervisors approves the <br /> tentative Williamson Act Contract Cancellation, that the Planning <br /> Commission make a motion of intent to approve the Planned <br /> District and Major Subdivision Applications, subject to the <br /> necessary project redesign as recommended in the Final EIR and <br /> the following recommended Condition of Approval. <br /> Recommended Conditions of Approval: <br /> 1. The Planned District Site Plan and proposed Tentative Map <br /> shall be redesigned so that the golf course, stable and all <br /> homesites are located within the hatched area surrounding <br /> North Tracy Lake, as shown in Figure 4. 7-15 (attached) of <br /> the Final Environmental Impact Report (Final EIR) , excluding <br /> the area designated as high sensitivity for cultural <br /> resources as shown on Figure 4.9-3 of the Final EIR <br /> (attached) . <br /> 2 . The applicant shall obtain an appropriative water right <br /> permit for the increased storage of runoff from Jahant <br /> Slough or from diversion runoff from the Mokelumne River. <br /> This will include the completion of any necessary studies, <br /> as required by the State Division of Water Rights, including <br /> determination of the availability of such water in Jahant <br /> Slough and the lower reaches of the Mokelumne River for <br /> appropriation. <br />
