Development Committee -3- note that based on the complexity of the proposed project, as well as of the impacts related to the project, both the suggested Conditions of Approval and "Findings of Environmental Significance" may be modified during the next few days while the Staff Report is being prepared. As the recommended Conditions of Approval will, if approved, result in a drastically different project then is envisioned by the applicant, it is expected that the applicant may wish to challenge the adoption of the recommended condition and Findings of Environmental Significance. Should this be the case, it is recommended that the applicant prepare alternative "Findings of Environmental Significance" based on alternative mitigation measures that they are proposing. These materials will be included with the Staff Report packets mailed to each Planning Commissioner, providing that they are submitted to this office no later than noon, on Friday, July 30, 1993 . Recommendation: The Development Services Division will be recommending that the Quarry Excavation component of the project be denied based on the above discussion; and, if the Board of Supervisors approves the tentative Williamson Act Contract Cancellation, that the Planning Commission make a motion of intent to approve the Planned District and Major Subdivision Applications, subject to the necessary project redesign as recommended in the Final EIR and the following recommended Condition of Approval. Recommended Conditions of Approval: 1. The Planned District Site Plan and proposed Tentative Map shall be redesigned so that the golf course, stable and all homesites are located within the hatched area surrounding North Tracy Lake, as shown in Figure 4. 7-15 (attached) of the Final Environmental Impact Report (Final EIR) , excluding the area designated as high sensitivity for cultural resources as shown on Figure 4.9-3 of the Final EIR (attached) . 2 . The applicant shall obtain an appropriative water right permit for the increased storage of runoff from Jahant Slough or from diversion runoff from the Mokelumne River. This will include the completion of any necessary studies, as required by the State Division of Water Rights, including determination of the availability of such water in Jahant Slough and the lower reaches of the Mokelumne River for appropriation.
