Mr. Wheeler and Ms. Sullivan
March 26, 1992
Page Three
(c) (1) Other public concerns substantially outweigh the
objectives of the Williamson Act .
While the Department applauds maintaining the oak and
riparian woodland as a nature preserve, there is no need to
cancel the contract in order to do this. The Williamson Act
specifically sanctions a wildlife habitat area as an allowable
"open space" use. It is true that the habitat protection offered A7
by the proposed conservation easement will presumably offer more
permanent protection to this area. Unfortunately, the public
benefits derived from the nature preserve, and recreational
facilities encompassed by this project, are limited by the fact
that no public access is to be provided.
The Department appreciates the opportunity to comment on the
DEIR. We hope that the farmland conversion impacts and ,Williamson
Act issues are given adequate consideration in the Final
Environmental Impact Report (FEIR) .
