Mr. Kerry Sullivan <br /> April 3 , 1992 <br /> Page Three <br /> garter snake (Thamnophis couchi i as) , tricolored blackbird <br /> (Agelatius tricolor) , tiger salamander (Ambystoma tigrinum <br /> californiense) , valley elderberry longhorn beetle <br /> (Desmocerus californicus dimorphus) , and Delta button celery <br /> (Eryngium racemosum) . <br /> The information contained in the Draft EIR regarding these <br /> species is brief and incomplete. Although the Draft EIR <br /> makes note of the possible presence of sensitive species, <br /> field surveys were either not included or done during a time <br /> of year when the species in question was inactive or absent <br /> from the project site. In order to avoid impacts to listed <br /> species, or reduce them to a level of insignificance, it <br /> will be necessary to determine their presence, distribution, Al2 <br /> and habitat use on the project site. <br /> We recommend that the Draft EIR be revised to include <br /> surveys for sensitive species. The DFG recommends that <br /> surveys be conducted at the time of year when endangered or <br /> threatened species are both evident and identifiable. Field <br /> surveys should be scheduled to coincide with the appropriate <br /> breeding or other life history stage of animals when they <br /> are likely to be evident, or with the peak flowering periods <br /> and/or phenological development that are necessary to <br /> identify plant species. Sensitive species survey reports <br /> should be included in the Appendices of the Draft EIR. <br /> Please be advised that the DFG regards any activity <br /> resulting in the loss of habitat, decreased reproductive <br /> success, or other negative effects on population levels of <br /> State-listed threatened or endangered species as "take" . <br /> Take is prohibited by Fish and Game Code Section 2080 . <br /> However, take of a threatened or endangered species may be A13 <br /> allowed after consultation with DFG pursuant to Fish and <br /> Game Code Section 2081. This process involves a management <br /> permit and agreement entered into by the project proponent <br /> and the DFG which requires formalized mitigation that must <br /> result in a net benefit to the species. Similar Federal <br /> Endangered Species Act sections apply for federally-listed <br /> species. <br /> 3 . The project fails to discuss the project' s impact on unique <br /> or significant native habitats. The proposed project has <br /> resulted in the destruction of mature riparian forest and A14 <br /> may result in the further destruction of additional riparian <br /> and foothill woodland forest as well as seasonal wetlands, <br /> oak savannah, and vernal pools. <br /> 111-9 <br />
