The applicant should be note that the PM-10 Fugitive Dust Rule (version date April 19,
1993) is currently proposed by the District for adoption in the near future. This rule may
affect the applicant's project. A copy of this rule is available upon request to the District.
2. The project proponent shall adhere to the mitigation measures as stated in the final
environmental impact report to reduce the significance of any potential air quality impacts .
3. In addition, rules and regulations of the District will apply to certain commercial and
industrial sources. The excavation project may be affect by the District's rule depending on
the operations of the project. If the excavation operation is determined to be within the
purview of the District's rules, then the applicant will need to apply for an Authority to
Construct and a Permit to Operate. It will be the applicant's responsibility to be in compliance
with these rules and regulations prior to operation.
The District appreciates the opportunity to comment on this project.
