The project is <br /> located in Sections 3 , 4 , 5, 8, 9, and 10, Township 4 North, <br /> Range 6 East, M.D.B. & M. , San Joaquin County California. <br /> The Corps of Engineers jurisdiction within the study areas <br /> is under the authority of Section 404 of the Clean Water Act for <br /> the discharge of dredged or fill material into waters of the <br /> United States. Waters of the United States include, but are not <br /> limited to, the following: perennial and intermittent streams, Al <br /> lakes, including Tracy Lakes, ponds, vernal pools, as well as <br /> wetlands in marshes, wet meadows, and side hill seeps. Project <br /> features that would occur from development within the project <br /> area that result in the discharge of fill material into waters of <br /> the United States will require Department of the Army <br /> authorization prior to initiating work. <br /> The range of alternatives considered in an Final EIR should <br /> include alternatives to fill in wetlands or other waters of the <br /> United States within the study area. Every effort should be made <br /> to avoid project features which require the discharge of fill <br /> into waters of the United States. In the event that it can be A2 <br /> clearly demonstrated that there are no practicable alternatives <br /> to filling in waters of the United States, mitigation plans <br /> should be developed to compensate for the losses resulting from <br /> project development. <br /> Please refer to identification number 1990001097 in any <br /> future correspondence regarding this project.
