I previously recommended a complete archaeological
report; however, the scope of the BioSystems report was limited. BioSystems was not
asked to survey septic tank locations, utility easements, laydown and construction
staging areas, the golf course, clubhouse, and roadways. I recommend that a new survey
of the specific areas where all subsurface work is to be done. In those areas that may be
deemed to be sensitive, a qualified archaeologist, who is acceptable to the Native B15
American community, and a qualified Native American monitor be present during all
subsurface actives. If the County does not feel that a survey of the specific areas is
necessary, then a qualified archaeologist, who is acceptable to the Native American
community, and a qualified Native American monitor be present during all subsurface
activities.
In the proposed mitigation measures of the BioSystems report, it states that all
impacts to the delineated archaeological sites can be avoided with modification to the
development plan. In addition to the above recommendations, I recommend that the
project be redesigned to protect and avoid impacts to all identified archaeological sites.
The possibility of uncovering Native American Human remains needs to be B16
addressed. Section 5097.94 (1) of the Public Resources Code deals with the attempt to
develop preburial agreements with interested landowners and the appropriate Native
American groups. If in the event that a preburial agreemcnt can not reached or one has
not been developed prior to the discovery of Native American human remains, Section
7050.5 (b) and (c) of the Health and Safety Code and Section 5097.98 (a) and (b) of
the Public Resources Code apply.
If you have any questions or need any additional information, please contact me.
S ncerely,
Deb ie Pilas-Treadway
Staff ervices Analyst
cc: State Clearing House
VI-27
