Inc. ("Chevron"), <br /> Texaco Downstream Properties,Inc. ("Texaco's, and ConocoPhillips Company <br /> ("ConocoPhillips"),is planning to be on site to implement work described in two reports: <br /> Additional Assessment Report and Work Plan for Additional Deep Groundwater Zone <br /> Assessment(dated July 29,2004) and the Addendum to Work Plan for Additional Deep <br /> Groundwater Zone Assessment(dated September 3,2004). Both reports were copied to Bill <br /> Brown and Kitty Walker. <br /> Although the Agreement for Settlement of Claims and General Release("Agreement") <br /> grants Chevron,Texaco, and ConocoPhillips access to RDA property for such work,the <br /> Agreement will not be effective until the Court has entered an order finding that the settlement <br /> was in good faith. As such,we propose that,pending the effective date of the settlement,the <br /> parties agree that SECOR's entry on to the RDA property will be pursuant to the same terms and <br /> conditions stated in the June 21,2004 License Agreement between the RDA and Chevron, <br /> Texaco,and ConocoPhillips. Chevron,Texaco,and ConocoPhillips will assume all of the <br /> obligations of Licensees under the June 21, 2004 License Agreement with respect to SECOR's <br /> work implementing the work plans described above. <br /> Please have the RDA sign below to indicate consent.
